1. Background to the Promotion of Access to Information Act
The Promotion of Access to Information Act, No. 2of 2000 (the “Act) was enacted on 3 February 2000, giving effect to the constitutional right in terms of section 32 of the Bill of Rights contained in the Constitution of the Republic of South Africa 108 of 1996 (the “Constitution”) of access to any information held by the state and any information that is held by another person and that is required for the exercise or protection of any rights.
In terms of section 51 of the Act, all Private Bodies are required to compile an Information Manual (“PAIA Manual”).
Where a request is made in terms of the Act, the body to whom the request is made is obliged to release the information, subject to applicable legislative and / or regulatory requirements, except where the Act expressly provides that the information may be adopted when requesting information from a public or private body.

To promote access to information, foster a culture of transparency and accountability.

The information regulator is, among others, empowered to monitor and enforce compliance by public and private bodies with the provisions of the Promotion of Access to Information Act, 2000 (act 2 of 2000), and the Protection of Personal Information Act, 2013 (act 4 of 2013).

6. The Act (Section 51(1) (b))
6.1 The ACT grants a requester access to records of a private body, if the record is required for the exercise or protection of any rights. If a public body lodges a request, the public body must be acting in the public interest.
6.2 Requests in terms of the ACT shall be made in accordance with the prescribed procedures, at the rates provided. The forms and tariff are dealt with in paragraphs 6 and 7 of the Act.
7. The Latest Notice in Terms of Section 52(2) (if any) [Section 51(1)(c)]
No notice has been published on the categories of records that are automatically available without a person having to request access in terms of Section 52(2) of PAIA.

10. Form of request
To facilitate the processing of your request, kindly:
10.1 Use the prescribed form, available on the website of the https://inforegulator.org.za/wp-content/uploads/2020/07/InfoRegSA-PAIA-Form02-Reg7.pdf.
10.2 Address your request to the Managing Director.
10.3 Provide sufficient details to enable the COMPANY to identify:
(a) The record(s) requested;
(b) The requester (and if an agent is lodging the request, proof of capacity);
(c) The form of access required;
(d) (i) The postal address or fax number of the requester in the Republic;
(ii) If the requester wishes to be informed of the decision in any manner (in addition to written) the manner and particulars thereof;
(e) The right which the requester is seeking to exercise or protect with an explanation of the reason the record is required to exercise or protect the right.
11. Prescribed fees
11.1 A requestor is required to pay the prescribed fees (R50.00) before a request will be processed;
11.2 If the preparation of the record requested requires more than the prescribed hours (six), a deposit shall be paid (of not more than one third of the access fee which would be payable if the request were granted);
11.3 A requestor may lodge an application with a court against the tender/payment of the request fee and/or deposit;
11.4 Records may be withheld until the fees have been paid.

12. Decision
12.1 Time Allowed to make a decision
Markdata (Pty) Ltd will, within 30 (thirty) days of receipt of the request, decide whether to grant or decline the request and give notice with reasons (if required) to that effect.
